Public Chapter 154, effective July 1, 2017, requires that five of the ten hours of continuing education obtained by a funeral director or embalmer to renew a license must be attended “in person”, which “means the continuing education coursework is completed by the licensee in the physical presence of the provider of the coursework or is completed by the licensee through an interactive virtual program that requires participants to confirm their presence during the program.” This requirement applies to all renewals on or after July 1, 2017 unless otherwise statutorily exempted.
*What does Public Chapter No. 154 (the new law) require?
Public Chapter No. 154 requires that five (5) of the ten (10) hours of continuing education coursework be attended in-person, which includes participation through a virtual program that requires participants to confirm their presence during the program, as well as programs attended in the presence of the instructor.
*When did the new law go into effect?
Public Chapter No. 154 went into effect on July 1, 2017.
*Do I have to take additional continuing education courses to meet the requirements of Public Chapter No. 154 if I have already completed ten (10) hours of continuing education coursework?
Public Chapter No. 154 requires everyone to meet this requirement regardless of their renewal date. Therefore, you may have to take additional courses in order to obtain the five (5) hours that must be attended in the physical presence of the provider or through an interactive virtual program requiring participants to confirm their presence during the program.
*How will I know if an interactive virtual program meets the requirements of Public Chapter No. 154?
Public Chapter No. 154 requires that the program confirm your presence during the program. Generally speaking, the Board has indicated that they will look for factors like programs that allow the submission of questions, group chat, or solicit responses from licenses through surveys, multiple choice questions, confirmations, etc., require a unique login and disable the ability to skip through content, have the ability to actively monitor participation, or include a testing component. The Board will be promulgating new rules to codify the requirements and, as such, the determinations must be made on a case-by-case basis at this time.
*How will I be required to show that the continuing education courses I took meet the requirements of Public Chapter No. 154?
You will be required to attest that the continuing education courses you took meet the requirements of Public Chapter No. 154. Board staff may also conduct compliance audits of some renewals to ensure compliance.
